This contract details the inclusions of services provided as specified by Orange Blossom Photography (“OBP”). The total fee is dependent on total time spent during session. The Conway and Loretta Package is $1,750 total. This fee includes a deposit of $525 with the remaining balance of $1,225 due before or day of receipt of services.
Services Provided are as follows:
- One expert photographer present and photographing during specified times, eight (8) hours of coverage
- Unlimited number of images
- Fully edited images e-mailed to Client within three (3) months of services provided or within time frame as requested by Client
- Two (2) flash drives with printable versions of files, not to be shared on social media
Limit of Liability: Orange Blossom Photography will make every effort to provide high quality photographic services. In the unlikely event that the photographer is injured, ill, or becomes otherwise incapacitated and is unable to perform, OBP will promptly notify the Client and strive to provide a comparable replacement. In the event of mechanical or other technical failures (such as lost, stolen, or damaged images/files), or any other circumstances beyond the parties’ control preventing performance of this contract, OBP shall not be liable for any amount in excess of all monies paid.
Image Ownership and Copyrights: Client acknowledges that all images created under this agreement are the intellectual property of OBP who shall retain the copyright to the images. Client agrees not to publish any of the images without written permission of the photographer. Client shall not post any images on any publically-viewable website unless OBP has specifically marked such images “for web use”. Client will have unlimited personal use of the “for web use” images at any time for no additional fee. Client also agrees not to digitally manipulate or crop the images “for web use” and otherwise, including but not limited to: message boards, social networking websites, public photo galleries. Any edit requests shall be made directly to OBP with opportunity for additional charges. OBP has permission to use the images for publication, display, advertising promotion and other uses. However, OBP will provide right of refusal to Client.
Image Storage/Archiving: OBP will archive the images for no less than 12 months (1 year) after services. Any access requests beyond those described in “services provided” above will be made by Client directly to OBP.
Print Release: OBP grants total print privileges to Client and family/friends of Client.
Cancellation/Rescheduling: In the event that the Client needs to reschedule or cancel the session, Client must notify OBP promptly. If OBP is unavailable for the new date, Client forfeits any deposits made and is entitled to the return of any other amounts paid.
This contract incorporates the entire understanding of Client and OBP. This agreement is governed by the laws of Kansas City, Wyandotte County, Kansas.
